These Terms of Service (“Terms”) govern your access to and use of Hard Money Loans of Jackson Hole (the “Site”), operated by Lead Skills, LLC(“we,” “us,” or “our”). By accessing or using the Site, submitting an inquiry, or communicating with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
The Site is a lead generation service that connects prospective borrowers with participating hard money lenders. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including approval, pricing, underwriting, and funding, are made solely by the participating lender. A current list of participating lenders is available upon request.
Nothing on this Site constitutes an offer, commitment, or solicitation to lend, nor should it be construed as tax, legal, accounting, or investment advice. Content is provided for general informational purposes only. Loan programs, availability, rates, and terms offered by participating lenders vary and are subject to change without notice. Not all applicants will qualify.
By using the Site or submitting an inquiry, you represent that you are at least 18 years old and legally able to enter into a binding contract. You further represent that all information you provide is accurate, current, and complete, and that you will update it as needed. You agree that we and participating lenders may rely on the information you submit.
By submitting an inquiry and checking the consent box, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text or calling 307-313-5330.
Hard Money Loans of Jackson Hole connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.
You agree to use the Site only for lawful purposes and in compliance with these Terms. You may not (a) submit false, misleading, or fraudulent information; (b) interfere with the security or operation of the Site; (c) attempt to gain unauthorized access to any system, account, or data; (d) use automated tools to scrape or harvest content; (e) use the Site to harass, defame, or harm others; or (f) violate any applicable law or regulation.
All content on the Site, including text, logos, graphics, images, layout, and code, is owned by Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written permission.
The Site may link to or integrate with third-party websites, platforms, or services, including those of participating lenders. We do not control and are not responsible for the content, practices, or policies of third parties. Your use of third-party sites or services is subject to their own terms and privacy policies.
THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT YOU WILL BE MATCHED WITH A LENDER, THAT ANY PARTICIPATING LENDER WILL CONTACT YOU, OR THAT ANY FINANCING WILL BE OFFERED OR APPROVED.
TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY INTERACTION WITH A PARTICIPATING LENDER, OR ANY FINANCING DECISION, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
You agree to defend, indemnify, and hold harmless Lead Skills, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or the rights of a third party, or (d) information you submit through the Site.
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will update the effective date above. Your continued use of the Site after the effective date constitutes your acceptance of the updated Terms.
